1. Acceptance of Terms

By accessing or using Formulate 360 (“the Service”) at formulate360.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Formulate 360 is an AI-powered formulation workspace that helps formulation chemists, product developers, and brand operators build formulas, generate SOPs, review compliance, and produce professional documentation. The Service includes AI-assisted features powered by third-party large language models.

3. User Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are solely responsible for all data you upload, create, or generate on the platform, including formula data, ingredient lists, and AI-generated outputs.
• You agree not to use the Service for any illegal purpose or in violation of any applicable regulations (including FDA, cGMP, or state-specific cannabis regulations).
• You represent that you have the necessary qualifications to review and validate any AI-generated formulation, SOP, compliance review, or safety data before production use.

4. AI Output Disclaimer

AI-generated outputs — including formula suggestions, SOPs, compliance reviews, labels, COAs, and SDS — are provided for informational and drafting purposes only. The Service is a formulation assistance tool and does not replace the professional judgment of qualified chemists, regulatory professionals, or safety assessors. All AI-generated outputs must be reviewed and validated by a qualified professional before production use. Formulate 360 makes no warranty as to the accuracy, completeness, or regulatory compliance of AI-generated content.

5. Intellectual Property

You retain all rights to the formulas, data, and content you create on the platform. Formulate 360 retains ownership of the platform, its code, and its proprietary AI models and prompts. By using the Service, you grant us a limited license to process your data solely to provide the Service.

6. Subscription & Billing

Subscription fees are billed in advance on a monthly basis via Stripe. You may cancel at any time from your Settings page; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. We may change pricing with 30 days' notice.

7. Limitation of Liability

To the fullest extent permitted by law, Formulate 360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, arising from your use of the Service or any AI-generated content.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may terminate your account at any time from the Settings page. Upon termination, your data will be permanently deleted within 30 days.
